Terms of Service

ScoreToClose, a free credit-coaching service offered by Tigh Gunderson, NMLS #1425877.

1. Operator

ScoreToClose is a free credit-coaching service offered by Tigh Gunderson, NMLS #1425877. References to "we," "us," "our," or "ScoreToClose" in these Terms refer to Tigh Gunderson operating ScoreToClose. Mailing address: <<MAILING ADDRESS — fill before public launch>>. 2. The Service Is Free

ScoreToClose does not charge consumers any fees, now or at any other time, for use of the credit-coaching service. Because the service is offered without consideration, ScoreToClose is not a "credit repair organization" as defined under the Credit Repair Organizations Act, 15 U.S.C. § 1679a. We provide educational tools, dispute-letter templates, and general guidance; we do not act as your attorney, financial advisor, or credit repair organization, and we do not promise any specific credit-score outcome.

3. Self-Service; You Send Everything Yourself

ScoreToClose is a self-service tool. We do not act as your agent in any dispute or correspondence with credit bureaus, furnishers, collectors, lenders, or any other party. We do not sign, mail, fax, email, file, or otherwise transmit any letter, dispute, complaint, or other communication on your behalf. Letters and templates generated through the service are educational drafts that you alone are responsible for reviewing, editing, signing, mailing, tracking, and following up on. You alone are responsible for the truth and accuracy of any statement you choose to send. ScoreToClose does not represent or speak for you to any third party.

4. Eligibility

To use ScoreToClose, you must be at least 18 years old, capable of entering into a binding contract, and a resident of the United States. The service is currently available only to residents of Utah. We reserve the right to refuse service or terminate accounts where eligibility cannot be reasonably verified.

5. Account and Accuracy

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to update it as needed. You are responsible for reviewing, editing, and approving any draft prepared using our tools before you choose to send it.

6. No Mortgage Tying

Use of ScoreToClose is offered as a complimentary service. You are NOT required to use Tigh Gunderson or any specific lender for your mortgage. You may choose any lender. Tigh Gunderson may, separately, offer mortgage origination services as a Utah-licensed loan officer, but selection of a lender is your decision and is not a condition of using ScoreToClose.

7. Realtor Sharing Is Consumer-Controlled

If you sign up through a real-estate professional's referral link, you may choose whether to authorize ScoreToClose to share your progress with that professional. Authorization is opt-in, is captured separately at sign-up, and may be revoked at any time from your account settings. When sharing is active, the realtor sees a limited dashboard view of your status and key milestones, not your uploaded credit reports, full Social Security number, or message contents.

8. NMLS Disclosure

Tigh Gunderson is a licensed mortgage loan originator, NMLS #1425877. You may verify this licensing at https://www.nmlsconsumeraccess.org. ScoreToClose is the credit-coaching service Tigh provides at no cost; mortgage origination services, if any, are offered separately.

9. Equal Credit Opportunity Act Notice

ScoreToClose and Tigh Gunderson do not discriminate against any applicant on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has the capacity to enter into a binding contract), because all or part of the applicant's income derives from any public assistance program, or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act. The federal agency that administers compliance with this law concerning ScoreToClose is the Federal Trade Commission, Equal Credit Opportunity, Washington, DC 20580.

10. Fair Housing Notice

We support the principles of the Fair Housing Act and do business in accordance with federal, state, and local fair-housing laws. It is illegal to discriminate against any person in the sale, rental, financing, or advertising of housing because of race, color, religion, sex, handicap, familial status, or national origin.

11. No Warranties; No Outcome Guarantees

The service is provided "as is" and "as available." To the maximum extent permitted by law, ScoreToClose disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Score projections, factor analyses, and improvement estimates are non-binding educational estimates. Actual credit outcomes depend on many factors outside our control, including creditor and bureau responses and your own actions. We do not guarantee any specific change in your credit score.

12. Limitation of Liability

Because ScoreToClose is provided to you free of charge, to the maximum extent permitted by law, our aggregate liability to you for any claim arising out of or relating to the service is limited to actual direct damages, which the parties agree are reasonably approximated by the fees you paid for the service: zero dollars ($0). In no event will ScoreToClose, its operator, or its affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost savings, or loss of data, even if advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless ScoreToClose and Tigh Gunderson from any third-party claim arising out of (a) your misuse of the service, (b) your violation of these Terms, or (c) your violation of any law or third-party right.

14. Arbitration and Class-Action Waiver

PLEASE READ CAREFULLY. Except for small-claims matters and requests for injunctive relief, any dispute arising out of or relating to the service or these Terms will be resolved by final, binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Salt Lake County, Utah, or by remote means as the AAA permits, and the arbitrator's award may be entered in any court of competent jurisdiction. The arbitration will be conducted on an individual basis only; class actions, class arbitrations, and representative actions are not permitted. You may opt out of this arbitration agreement by sending written notice to legal@scoretoclose.com within 30 days of first accepting these Terms; the notice must include your name, account email, and a statement that you decline arbitration. These Terms are governed by the laws of the State of Utah, without regard to conflict-of-laws principles.

15. Termination

You may terminate your account at any time from the in-app settings page or by emailing privacy@scoretoclose.com. We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms or engaged in fraud, abuse, or unlawful conduct. Sections 3, 11 through 14, 16, and 18 survive termination.

16. Electronic Communications Consent (E-SIGN)

By creating an account, you consent to receive notices, agreements, disclosures, and other communications from ScoreToClose in electronic form, including by email and through the application, and you agree that those electronic communications satisfy any legal requirement that they be in writing. To withdraw this consent or to request paper copies, email privacy@scoretoclose.com; withdrawal may require us to terminate your account because the service is delivered electronically.

17. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you by email and within the application before they take effect. Your continued use of the service after the effective date of the updated Terms constitutes acceptance of the changes.
